U.S. Department of Education Releases Guidance Regarding FERPA and COVID-19

On March 12, 2020, the U.S. Department of Education released guidance for educational institutions regarding compliance with the Family Educational Rights and Privacy Act in the context of the coronavirus outbreak (COVID-19). The guidance specifically addresses an educational institution’s obligations to protect the privacy of student education records, as well as the conditions under which an institution may potentially disclose certain Personally Identifiable Information without a student’s prior written consent in circumstances related to COVID-19.
